General terms and conditions (of delivery)


1. General stipulations

1.1 This User Agreement governs the terms and conditions that apply to the use of the information and services on this website. These services are offered by Scouts & Gidsen Vlaanderen vzw Hopper Winkel, with registered office at Wilrijkstraat 45, 2140 Antwerp (company registration number: 0407.138.494 and VAT number: BE0407.138.494), hereafter referred to as Hopper Winkel.

1.2 The services provided by this web store shall only be available to registered users. Registration shall be through the registration procedure on our website www.hopper.be/shop

1.3 By registering as a member of this web store, the user agrees to the following terms and conditions of use and general terms and conditions of sale of Scouts en Gidsen Vlaanderen vzw Hopper Winkel. These conditions can also be accessed through our website.

Additional terms and conditions of the user shall be excluded, unless we have specifically accepted them in writing beforehand.



2. Terms and conditions of use

2.1 The use of our services shall be reserved to persons with a legal capacity to enter into a User Agreement. This means that the services on our website cannot be used by minors (below the age of 18) and/or others who by law do not have the necessary competence. By registering as a member of our website, the user guarantees that they are of legal age.

2.2 The user guarantees that any data provided by them from the point of registration shall be truthful and accurate. The user shall be obliged, among other things, to inform Scouts en Gidsen Vlaanderen vzw Hopper Winkel in writing of any changes to the data provided during the registration procedure.

2.3 Users shall be responsible for accessing their account, including personal usernames and passwords. These access keys shall be strictly personal and confidential and must consequently not be transferred or assigned to third parties.

2.4 Users shall impose any necessary measures to prevent their personal account from being accessed by third parties, in particular minors in their surroundings.

3. General terms and conditions of sale

3.1 ORDER:

Any articles on the website shall be presented with an article number, a detailed description of their characteristics and a photograph.

Despite the fact that our website has been compiled with the greatest possible care, some of the information provided may be incomplete, contain material errors or not be up to date. Obvious mistakes or errors in the offer shall not be binding. We shall only be bound by a best efforts obligation with respect to the accuracy and completeness of the information provided. Under no circumstances shall we be liable in the event of obvious material, typesetting or printing errors.

For some items, users shall have to indicate their desired size before being able to place an order. The desired number of items must also be indicated for all products. Users can first include the desired item in an order, which shall subsequently be confirmed as follows.

When items have been added to their basket, users will be able to see an overview of the selected items. Users shall then have the following options:

  • To order the list of selected items;
  • To remove one or more items from the list;
  • To remove every item on the list;
  • To supplement the list of selected items by continuing their shopping experience.

Final confirmation of the order by the user shall constitute their acceptance of the order at the set price and acceptance of delivery of the goods to the address which the user previously registered.

We shall be entitled to refuse an order in the event of a serious shortcoming on the part of the user relating to orders the user is dealing with.

3.2 OFFER AND CONCLUSION OF THE AGREEMENT:

The remote agreement shall be concluded when Scouts & Gidsen Vlaanderen vzw Hopper Winkel has sent an e-mail confirming the order placed by the user to the e-mail address provided during the registration procedure.

In view of the fact that the user has accepted the offer on the Hopper Website by placing an order online, they agree that this has resulted in a valid agreement. The absence of a normal signature shall not affect the binding nature of the offer and its acceptance. The confirmation e-mail shall serve as proof of the transaction.

Special offers shall be valid while stocks last.

3.3 PRICES:

Prices are in euro and include VAT (Value Added Tax), but exclude shipping costs.

Prices refer solely to articles as they are specifically described. The accompanying photographs are purely for illustration purposes and may contain elements that are not included in the price.

3.4 PAYMENT:

The following payment methods are available:

  • Credit card: Visa and MasterCard
  • Debit card: Maestro and Bancontact/Mister Cash

Payments on the Hopper web store are secured by Secure Socket Layer (SSL) technology, to ensure that your data is secure during any sales transactions with us.

3.5 DELIVERY:

Unless agreed otherwise, orders shall be delivered to the address provided by the user at the time of registration.

Delivery shall normally be within ten working days (not including Saturdays, Sundays and public holidays) of the day following the day on which Scouts & Gidsen Vlaanderen vzw Hopper Winkel has sent a confirmation e-mail to the user stating that the order has been received. Delivery of items made to specification, made to measure or to suit the customer’s specific requirements (group ties, special badges, etc.) may take longer depending on the relevant production time.

Delivery costs, i.e. postage and delivery, shall be at the user’s expense.

Shipping costs shall be calculated on the basis of the weight of the items and shall be added to your shopping cart at checkout. Bpost / Bpack charge the following rates for domestic shipments.

Shipments in excess of 30 kg will be delivered by our regular carrier and the shipping cost will be calculated by the web store in advance.

We also ship to the Netherlands and Luxembourg at the Bpack rates applicable at the time.

We reserve the right to change delivery costs unilaterally in line with current market prices.

3.6 DEFECTS AND COMPLAINTS PERIOD:

Until the time of delivery, the risk of damage and/or loss of an ordered product shall be at the expense of Scouts en Gidsen Vlaanderen vzw Hopper Winkel.

We would also like to remind the user of the existence of a legal guarantee of conformity for the goods.

The user shall be obliged to check the conformity of the delivered item at the time of delivery. This means that the user must check whether the delivered item shows any signs of visible defects upon delivery. Complaints regarding visible defects must be communicated immediately by letter or e-mail, at the latest within 2 working days of delivery of the goods. Complaints outside this period shall be considered late.

Complaints concerning hidden defects in delivered items must be communicated immediately by letter or e-mail within 2 working days of the identification of the hidden defect.

3.7 RIGHT OF WITHDRAWAL/CANCELLATION AND RETURN:

The Code of Economic Law, Book VI, stipulates that the user has the right to withdraw from the order without having to pay a penalty or provide justification. The user shall exercise this right of withdrawal within 15 working days of the day following the delivery of the purchased item. Once this period has expired, the user shall no longer be able to cancel their order and the purchase shall consequently be final.

If the user exercises their right of withdrawal, Scouts en Gidsen Vlaanderen vzw Hopper Winkel undertakes to refund the amount received within fourteen (14) days of the withdrawal. The refund shall also include the initial shipping cost. In the event of withdrawal, the cost of returning the delivered goods shall be at the user’s expense.

Unless specifically requested otherwise, refunds shall be made by bank transfer into the account Scouts en Gidsen Vlaanderen vzw Hopper Winkel was provided with at the time of registration.

An item to be returned must not be used and must remain in the condition it was in at the time of delivery. Any complementary documentation, warranty certificates and packaging materials must be enclosed in the return shipment.

Returns shall be made through the same route as the delivery.

Conditions:

  • Goods shall be in their original condition, i.e. undamaged, unworn, with labels still attached.
  • You must notify us by phone or e-mail that you are returning one or more items within 5 days of receiving the order.
  • Please use this standard form (in accordance with appendix 2 of Book VI of the Code of Economic Law).
  • Goods must be returned by the customer within 14 days of notification of the return.
  • Unfranked or insufficiently franked returns shall not be accepted.
  • Discounted items shall not be taken back.

The original purchase price, including the initial transport costs, will be credited to the account on receipt of the goods in undamaged condition and refunded within fourteen (14) days.
Postage for the return shipment shall be at the buyer's expense, unless an error was made in the order or delivery by Hopper Winkel and Hopper has specifically agreed to pay for the return.

Reduction in returns value: if it appears that the customer used the item over and above what was necessary to assess whether they actually wanted to retain it, Hopper shall be entitled to apply a reduction in value for the purpose of repayment (e.g. a garment that is returned dirty or with a funny smell, shoes with damaged soles, etc.).

Scouts & Gidsen Vlaanderen vzw Hopper Winkel shall not be liable for damage, theft or loss when an item is returned.

Article VI.53 of the Code of Economic Law stipulates that the user shall not be able to exercise their right of withdrawal for:

1° service contracts, following the implementation of the service, providing it went ahead with the consumer's specific prior consent and the consumer acknowledged that they would lose their right of withdrawal as soon as the company had implemented the agreement in full;

2° the supply or provision of goods or services the price of which is linked to fluctuations in the financial markets, which the company cannot influence and which might occur within the cancellation period;

3° the supply of goods made to the consumer's specifications or clearly intended for a specific person;

4° the supply of goods that spoil quickly or have a limited shelf life;

5° the supply of sealed goods not suitable for return, for health or hygiene reasons or if the seal was broken following delivery;

6° the supply of goods that by their very nature were irretrievably mixed with other products following delivery;

7° the supply of alcoholic beverages at a price agreed when the sales contract was concluded, but delivery of which can only take place after 30 days, and the actual value of which depends on market fluctuations which the company cannot influence;

8° agreements whereby the consumer has specifically requested the company to pay a visit to carry out urgent repairs or maintenance on site. However, if during such a visit the company provides additional services not specifically requested by the consumer, or supplies goods other than spare parts required to carry out the maintenance or repairs, the right of withdrawal shall apply to those additional services or goods;

9° the supply of sealed audio and video recordings and sealed computer software, if the seal was broken following delivery;

10° the supply of newspapers, magazines or periodicals, with the exception of agreements pertaining to a subscription to such publications;

11° agreements concluded at a public auction;

12° the provision of accommodation other than for residential purposes, transport, car rental services, catering and leisure-related services, if a specific performance date or period is stated in the agreements;

13° the supply of digital content not made available on a tangible medium, if the implementation has started with the consumer's specific prior consent and the consumer has acknowledged that they thereby lose their right of withdrawal;

14° agreements for betting and lottery services.

3.8 RETENTION OF TITLE CLAUSE

In the event of non-payment or partial payment, Scouts en Gidsen Vlaanderen vzw Hopper Winkel shall retain exclusive ownership of the delivered item(s), in spite of the fact that they were actually delivered. This implies that Scouts en Gidsen Vlaanderen vzw Hopper Winkel has the right to recover the items as long as the outstanding debt has not been paid in full, including reimbursement of the principal sum, legal interest and other additional costs such as delivery costs.

The user shall consequently not dispose of, or encumber, the delivered items in any way, which means, among other things, that the user shall not sell on or transfer the delivered items to a third party subject to certain conditions until payment has been made in full.

3.9 AMENDMENT

Scouts en Gidsen Vlaanderen vzw Hopper Winkel reserves the right to amend the User Agreement, including the general terms and conditions, at any time. Publication on the website of Hopper Winkel shall be sufficient for it to be legally valid and shall take effect immediately upon publication.

3.10 NOTICE

The user shall be entitled to terminate their membership, and consequently this User Agreement, at any time by unsubscribing. They can unsubscribe by sending an e-mail to winkel@hopper.be, stating their name and e-mail address and specifically mentioning that they want to unsubscribe.

3.11 INTELLECTUAL PROPERTY RIGHTS

Any text, page references, illustrations, photographs, data sheets and other illustrative elements on the website are protected by intellectual property rights and in particular by copyright.

When entering into this User Agreement, the user undertakes to uphold these intellectual rights relating to the www.hopper.be site, including all intellectual rights vested in the creator of this site.

All intellectual property rights in this matter belong to Scouts en Gidsen Vlaanderen vzw Hopper Winkel. This means that, without prior permission from Scouts en Gidsen Vlaanderen vzw Hopper Winkel, the user must refrain from reproducing and/or processing this information other than for personal, non-commercial purposes.

3.12 PRIVACY POLICY

3.13 APPLICABLE LAW AND COMPETENT COURTS

This agreement shall be governed by Belgian law, to the exclusion of the Vienna Sales Convention.

The electronic agreement shall be concluded upon receipt of the order from the user by e-mail, at the time of its opening at our registered offices in Antwerp. We will send you a confirmation e-mail. Any disputes relating to this agreement or its conclusion shall be submitted to the district court or court of first instance in Antwerp.

If any provision of these general terms and conditions is declared invalid, unlawful or null and void, it shall in no way affect the validity, legality and applicability of the other provisions.

Failure by us at any time to enforce or exercise any of the rights listed in these general terms and conditions shall never be considered a waiver of such provisions and shall never affect the validity of our rights.
